POSTING AND PUBLICATION OF INVITATION TO BID

AN ORDINANCE REGARDING POSTING AND PUBLICATION

OF INVITATION TO BID

Be it ordained by the City of Warwick:

SECTION I. Chapter 56 of the Code of Ordinances of the City of Warwick is hereby amended by adding thereto the following section:

Sec. 56-4. Posting and publication of invitation to bid; contents.

Public notices are to be posted at five public places within the city which the purchasing agent may designate. In addition to such posted notices, notice may include publication in a newspaper of general circulation published daily in the State of Rhode Island as determined by the purchasing officer for the municipality not less than ten days prior to the date set for the opening of bids. All notices are to state a general description of the article or articles to be purchased; the quality, grade, quantity and delivery date; the location where bid forms and specifications can be obtained; and the date, time and place set for the opening of bids.

Any and all bids for motorized vehicles shall include a provision that bidders provide responses that include pricing for alternative fuel arrangements in such motorized vehicles, such as, but not limited to E-85, hybrid and bio-diesel alternative fuel arrangements.

Any and all bids shall contain a certification and warrant that they comply with all relevant and pertinent statutes, laws, ordinances and regulations, in particular, but not limited to Chapter 16-Conflicts of Interest, of the Code of Ordinances of the City of Warwick. Any proven violation of this warranty and representation by a bidder at the time of the bid or during the course of the contract, including but not limited to negligent acts, either directly or indirectly through agents and/or subcontractors, shall render the bidder’s contract terminated and the bidder shall be required to reimburse the City for any and all payments provided under in violation of this prohibition and for any and all costs incurred by the City, including reasonable attorney fees, to prosecute and/or enforce this provision.

SECTION II. This Ordinance shall take effect upon passage and publication as prescribed by law.
