MORTGAGEE’S SALE OF REAL ESTATE

By virtue and in execution of the Power of Sale contained in a certain Open-End Mortgage and Security Agreement to Secure Present and Future Loans Under Chapter 25 of Title 34 of the General Laws, given by The Bantom Corporation, a Massachusetts corporation (the “Mortgagor”) to William A. Busa and Daniel P. Busa, Jr. (the “Mortgagee”) which mortgage is dated October 9, 2008 and recorded with the City Clerk of the City of Warwick Rhode Island in Book 6933, Page 87 (the “Mortgage”), for breach of the conditions of said Mortgage and for the purpose of foreclosing the same, there will be sold at Public Auction beginning at 9:00 A.M. on the 5th day of March, 2015 on the premises located at 1325 Post Road, Warwick, Rhode Island, all and singular the premises and property described in said Mortgage as the Property (hereinafter, the “Mortgaged Property”), which Mortgaged Property consists of that certain parcel of land together with the improvements situated thereon and the appurtenant rights associated therewith, which land is more particularly described in the Mortgage as follows, to wit:

“EXHIBIT “A”

The land known as 1325 Post Road, Warwick, Kent County, Rhode Island, being that certain parcel of land with all the buildings and improvements thereon situated on the northwesterly side of Post Road in the City of Warwick, County of Kent, State of Rhode Island, is bounded and described as follows:

Beginning at an iron pipe in the northwesterly line of Post Road which said point is the southeasterly corner of the herein described parcel of land on that plat entitled “The Cambridge Park Plat” which plat is recorded in the office of the Warwick City Clerk on Plat Card 104; thence running in a

NORTHWESTERLY direction bounded northeasterly in party by Getty Oil Company land, in part on land of William and Ella Moran, and in part on land of Emile and Rita Bourassa, a distance of two hundred sixty-six and 71/100 (266.71) feet to granite bound at the northerly corner of the premises herein described; thence turning an interior angle of 81 degrees 55' and running

SOUTHWESTERLY bounded northwesterly in part on land of Geraldine Cadman, in part on Sargent Street, and in part on land of Joseph Raymond, while passing through an existing granite bound on line at the corner of Sargent Street and said Cadman land, a distance of one hundred sixty-eight and 66/100 feet (168.66) feet to another granite bound at the northwesterly corner of this said parcel of land; thence turning an interior angle of 97 degrees 43' and running

SOUTHEASTERLY bounded southwesterly on lands in part of Julia Beauchamp, Vittorio Mignanelli, and said grantee Alwa Equities, Inc. a distance of two hundred sixty-nine and 47/100 (269.47) feet to an iron pipe located on said Post Road; this said iron pipe is the most southerly corner of this parcel; thence turning an interior angle of 81 degrees 16' and running in a

NORTHEASTERLY direction along the northwesterly line of Post Road a distance of one hundred sixty-seven and 39/100 (167.39) feet to the point and place of beginning; thus forming an interior angle of 99 degrees 06' with the first mentioned course of this herein described parcel of land.

The Mortgaged Property will be sold subject to those matters set forth above and to and/or with the benefit of, inter alia, all rights, restrictions, encroachments, improvements, easements, outstanding tax titles, municipal or other public taxes, water, electric and sewer charges, assessments, liens or claims in the nature of liens, if any, to the extent the same are prior to the Mortgage, to tenancies or occupation by persons on the Mortgaged Property now and at the time of said auction, which tenancies or occupation are subject to the Mortgage, to all encumbrances of record which have priority over the Mortgage, including, but not limited to, a First Mortgage held by ANNA GOULD, TRUSTEE of the ANNA GOULD TRUST which mortgage is dated October 9, 2008 and recorded with the City Clerk of the City of Warwick Rhode Island in Book 6933, Page 71 and Conditional Assignment of Leases and Rents dated October 89, 2008 and recorded with the City Clerk of the City of Warwick Rhode Island in Book 6933, Page 81, covenants, conditions, restrictions, reservations, easements, liens for assessments, options, powers of attorney and limitations on title, all leases and tenancies having priority over the Mortgage, to rights or claims in personal property installed by tenants or former tenants now located on the Mortgaged Property, and also to all laws and ordinances including, but not limited to, all building and zoning laws and ordinances, all permits and approvals and all conditions contained in said permits and approvals granted in connection with the Mortgaged Property, and also to all rights of the public or rights of the state or federal government or their subdivisions arising as a matter of or under any law. The Mortgaged Property shall be sold only in whole and not in part. Please be advised that the Mortgaged Property includes, and the Mortgagee shall hold a public sale of, all personal property rights, title and interest (the “Personal Property”) in which the Mortgagee holds a security interest in connection with the Mortgaged Property. The sale of the Personal Property shall be included with the sale of the Mortgaged Property, and there shall be one sale, for one total price, of the Mortgaged Property, including the Personal Property. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to postpone further at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date.

TERMS OF SALE: A deposit of One Hundred Thousand and No/100 Dollars ($100,000.00) will be required to be paid by cash or certified bank cashier’s check with no intervening endorsements to William A. Busa and Daniel P. Busa, Jr. by the purchaser at the time and place of sale as earnest money. Balance to be paid by certified or bank cashier’s check with no intervening endorsements at the offices of Posternak, Blankstein & Lund LLP, 800 Boylston Street, Boston, Massachusetts 02199, within 30 days from the date of sale. The deed shall be delivered at the time of said payment of the balance of the purchase price.
