SHOPLIFTING

Officer Stephen Major was dispatched to the Target Store at 400 Bald Hill Road at approximately 3:50 p.m. on June 4 in reference to a shoplifter in custody. Major met with a loss prevention officer, who said he observed a male enter the men’s shave department pushing a carriage with his personal red jacket and select numerous Gillette Fusion shaving cartridges as well as several bottles of men’s cologne and place the items under his jacket contained within the main compartment of the carriage. He then proceeded to the electronics department where he selected other items before exiting the store, passing all points of purchase and making no attempt to pay for the merchandise. Loss prevention said they stopped the man outside and escorted him to the loss prevention office and contacted Warwick Police. Loss prevention said the man had taken 40 items with a value of $1,018.06 and they wished to pursue charges. Major said he placed Leo J. Levesque, 51, of 24 Manuel Avenue, Johnston in handcuffs and transported him to Warwick Police Headquarters, where he was jailed and processed without incident. Major said Levesque was charged with felony shoplifting due to a prior conviction and the fact that the total value of the shoplifted items was over $100. He was also charged as a habitual offender shoplifting due to the fact that he’s had three previous convictions for shoplifting. Major said Levesque was a probation violator as well. Levesque was held for the next session of Third District Court.

Officer Charles Austin Jr. was dispatched to the Home Depot at 80 Universal Boulevard at approximately 1:41 p.m. on June 7 for the report of a shoplifting. While en route, Loss Prevention informed Dispatch they had a male in custody. Austin spoke with a store employee, who said he observed an individual enter Home Depot with an empty carriage and then proceeded to the air conditioning section, where he viewed several air conditioners and then selected one and placed it in his carriage. The man then proceeded to the returns desk and said he would like to return the air conditioner and handed the associate a receipt. The associate refunded the subject with cash in the amount of $307.20. Loss Prevention then approached the subject, detained him and called police. Austin said the individual being held was identified as David Matthew Hobin, 32, of 228 Washington Avenue, Providence. Austin said he was able to get a copy of the receipt Hobin used and determined it was a Home Depot receipt from the Johnston store at 100 Stonehill Road. The receipt showed that an individual had purchased a 10,000 BTU portable air conditioner. Austin said Hobin did not tell him how he was able to obtain the receipt, which he took to the Warwick Home Depot and attempted to return the product without purchasing it. Austin said the money was returned to Home Depot and Hobin was arrested and transported to Warwick Police Department Headquarters, where he was fingerprinted and processed. Hobin was charged with one count of Obtaining Money Under False Pretenses. Due to his lengthy criminal history and the fact that he was on probation, Austin said he would be transported to the A.C.I. at a later date and time.

DUI

Officer Jamey Petit was dispatched to Sparrows Point III on Hardig Road at approximately 12:20 a.m. on June 8 for the report of a motor vehicle accident. Petit said he was advised by Dispatch the accident occurred in the parking lot of Sparrows Point III and that a female caller notified the police. The woman indicated that her daughter was in the lot arguing with a male who had just struck her vehicle. Upon arrival, Petit said he observed a male exiting a parked silver Chevy pickup, close the driver’s door and stumble toward him. Petit said the vehicle was parked somewhat diagonal in the spot. When asked what happened, the man told Petit, “I don’t know. Ask her,” and pointed to a female. Petit said he immediately detected a strong odor of an alcoholic beverage emanating from his breath. He said the man then attempted to enter his vehicle but Petit advised him not to. He conducted a pat down and secured the man in the back of his cruiser. He said he then spoke with the female who was on scene, who said she was in her mother’s apartment, which overlooks the parking area and her vehicle. She witnessed a black Chevy pickup as it attempted to back into a parking spot, but instead struck the front bumper of her mini-van. She said she witnessed the man exit his vehicle, then notified police and confronted him.

While speaking to the man, Petit said in addition to detecting a strong odor of an alcoholic beverage emanating from his breath, he was unsteady on is feet “to the point where I almost had to assist him in standing” and his eyes were extremely red, bloodshot, and watery. Petit said he asked the man if had consumed any alcohol and he said he had “two or three beers.” He said he had just left Applebee’s on Quaker Lane. After producing his license, Petit said the man agreed to submit to a series of standardized field sobriety tests. Petit said based on his contact with the operator and his performance on the sobriety tests, which included swaying and being unable to maintain his balance, he determined that he was unfit to operate a motor vehicle safely and advised Donald F. Deligero, 47, of 11 New Lexington Road, North Kingstown he was under arrest for the suspicion of operating a motor vehicle while under the influence of intoxicating liquor and/or drugs. Deligero was then transported to Warwick Police Headquarters, where he refused to make a confidential phone and refused to submit to a chemical test. Petit said Deligero was processed and issued violations for DUI with BAC unknown with a Third District Court date, and refusal to submit to a chemical test first offense with an R.I. Traffic Tribunal court date. He was released in the lobby to a sober adult.

    Fortunately, he KNEW a sober adult...I imagine there's nothing worse than waiting around the station waiting until you're sober enough to release. Keep drinking and you'll run out of Sober Adults willing to come down and get you in the wee hours.
