SHOPLIFTING

Officer Timothy Lipka responded to J. C. Penney at the Warwick Mall, 400 Bald Hill Road, at approximately 3:11 p.m. on June 17 for a report of two adult females detained for shoplifting. Upon arrival, Lipka met with a loss prevention officer, who said she observed two females, later identified as Wednesday P. Cruz, 19, of 40 Perkins Avenue, Cranston and Lexus R. Taveras, 21, of 127 Pleasant Street, Cranston, selecting makeup and concealing it in their handbags, as well as a men’s fragrance, which was concealed in a baby stroller. The women then exited the store, passing all points of purchase but making no attempt to pay for the concealed merchandise. Loss prevention approached the women outside the store, identified themselves and escorted the women back inside to the Loss Prevention office. Lipka said Cruz had stolen two items of makeup, representing a total value of $75, and Taveras had stolen a men’s fragrance valued at $66, all of which was recovered. Loss prevention said they wished to press charges. At this time, Lipka said the women were advised they were No Trespassed from J. C. Penney at Warwick Mall. He said it should be noted that Taveras was accompanied by her infant daughter. Taveras then called a friend to come take custody of her daughter. Both Taveras and Cruz were then arrested and transported to Warwick Police Department Headquarters, where they were eventually fingerprinted, processed and released. Lipka said both women were charged with one count of Shoplifting – Misdemeanor, with a mandatory Third District Court date.

Officer Timothy Lipka responded to the Wal-Mart at 840 Post Road at approximately 5:19 p.m. on June 16 for the report of a shoplifting. Lipka said he responded to the scene and met with Officers Aaron Kay and Brian Chianese, who had a male subject in custody who was suspected of shoplifting. The subject was identified as Zachary A. Coningford, 22, of 52 Chambly Avenue, Warwick, who had a full (hold without bail) bench warrant out of Superior Court for failure to appear. A Wal-Mart Asset Protection officer said he observed the subject select a cell phone battery charger and two Micro SD cards and conceal the items in his backpack. He then proceeded to the Pet Department, where he selected ferret food and other items and concealed those items in his backpack. The man then exited the building, passing all points of purchase but failed to render payment for the concealed merchandise. Upon exiting the store, he was approached by Asset Protection, who identified themselves and detained him. Lipka said all merchandise was recovered at the scene, worth a total value of $49.40. Asset Protection said Wal-Mart wanted to press charges. Coningford was then arrested and transported to Warwick Police Department Headquarters, where he was fingerprinted, processed and transported to the Adult Correctional Institution due to his Superior Court warrant. Coningford was issued a Third District Court Summons for Shoplifting – Misdemeanor.

DUI

While on a radar post on Bald Hill Road at 1:12 a.m. on June 14, Officer Thomas Duncan observed a vehicle operating at a high rate of speed, which he clocked at 48 mph in a clearly posted 35 mph zone. He said no other vehicles were observed on the roadway. After the vehicle passed his location, Duncan said he followed the vehicle as it continued northbound on Bald Hill Road at a high rate of speed. While following, Duncan said he observed the vehicle swerve from the high-speed lane to the low speed lane several times, and almost came close to striking another vehicle in the low speed lane. While going passed McDonald’s on Bald Hill Road, Duncan said the vehicle failed to use its turn signal, turned into the other lane of travel and began heading southbound and swerved into the breakdown lane twice. Duncan said at that point a traffic stop was conducted on Bald Hill Road in front of Taco Bell.

Duncan said he approached the vehicle and asked the operator for her license, registration and proof of insurance. At that point, Duncan said the woman looked at him with a blank stare and said nothing. After advising her of the traffic stop, Duncan said the woman was eventually able to provide her license, registration and proof of insurance. He said the woman was identified as Gina K. Delgiudice-Graham, 47, of 45 Exchange Road, West Warwick and her vehicle registration and insurance card were both inactive. While speaking with Gina, Duncan said he immediately detected the strong odor of an alcoholic beverage emanating from her breath and asked is she had been drinking that evening, to which she said, “Yes, I’ve had four drinks.” Duncan said it should be noted Gina was not able to specify what kind of drinks she had consumed. When asked where she was coming from, Gina said she was coming from Bar 1500 in Cranston and that she was headed home. While speaking with Gina, Duncan said he noticed her speech was extremely slurred she had severely bloodshot and watery eyes.

Duncan said Gina agreed to submit to a series of Standardized Field Sobriety Tests, but while exiting her vehicle she was unsteady on her feet and had to reach out to her car for balance. During the tests, Duncan said he observed Gina to be extremely unsteady on her feet, swayed from side to side and could not maintain her balance.

Following the tests, Duncan said he formed the opinion that Gina was intoxicated to the point where she could not safely operate a motor vehicle and she was arrested and transported to Warwick Police Department Headquarters, where she refused to submit to a chemical test but made a phone call to arrange for a ride from the station. She was then processed and secured in a cell. Delgiudice-Graham was issued a violation for one count of DUI drugs and/or alcohol first offense BAC unknown, with a District Court date, as well as violations for one count of refusal to submit to a chemical test first offense, speeding, laned roadway violations, turn signal required, and operating without evidence of insurance with an RI Traffic Tribunal court date.

    If shoplifters read this paper, or had ANY idea how many cameras there are in stores, they wouldn't THINK of taking something they didn't pay for. Warwick Mall has impressive surveillance and recording gear observing not just the mall, but the parking lots and theater as well (plus the major stores have their own undercovers, cameras, and theft detection devices.

    Stealing less than $50 worth of merchandise turns into hundreds or thousands in fines, or possible time in ACI Intake if they have a warrant or steal more than $100 worth of property.

    One of these wizards lives literally TWO BLOCKS from the WalMart, and he will probably be trespassed from the store- can't shop at the store closest to his residence...brilliant!
