MARIJUANA

On Aug. 26, the Statewide Grand Jury reported out an indictment charging Brett Mistofsky, 39, of 181 Lakeside Avenue, Warwick, with one count of possession of marijuana over five kilograms, two counts of marijuana with intent to deliver, one count of possession of a firearm while in possession of marijuana, two counts of conspiracy to violate the controlled substances act, and one count of possession of a controlled substance. Additionally, codefendants Tonya Bess, 39, of 30 Salem Trail, Narragansett, and Thomas Mellor, 44, of 2062 Broad Street, Cranston, were each charged with one count of conspiracy to violate the controlled substances act and one count of possession of marijuana with intent to deliver.

It is alleged that Listofsky, Bess, and Mellor operated an illegal marijuana manufacture and distribution network throughout Rhode Island. On Oct. 2, 2014, the Rhode Island Police High Intensity Drug Trafficking Area Task Force (HIDTA) executed search warrants at multiple locations in Narragansett and Warwick.

In total, the search warrants resulted in the seizure of approximately 45 pounds of marijuana, 49 marijuana plants, 2.5 pounds of hash oil, 23 vials of steroids and $29,298 United States currency.

All three defendants are scheduled to be arraigned in Kent County Superior Court on Sept. 18, 2015.

MISSING FISHING RODS

Officer Geoffrey Waldman was dispatched to Harbor Lights Marina at 200 Gray Street at 4:59 p.m. on Aug. 14 for the report of a larceny from a boat. Upon arrival, Waldman made contact with the reporting party, who said he had gone to check on his boat at 5:30 a.m., before work. When he arrived, he said he noticed his three fishing rods and reels were missing from his boat. He said the fishing rods were located in the rod holders above the center console of his boat, and the last time he was at the boat was on Aug. 10 at 12:30 p.m. with his son. The man identified the fishing rods as one 9-foot St. Croix surf rod, Triumph model, with a Penn 5500 spinfish V reel with a braided line valued at approximately $325; one 8-foot St. Croix surf rod, Triumph model, with a Penn 4500 spinfish V reel, with a braided line valued at approximately $300; and one 7-foot Penn Battle combo rod and reel, with a braided line valued at approximately $140.

The man told Waldman he does not have any suspects in mind, nor does he have any enemies. He said he has been at the marina all year without any problems and he was unaware of anyone else who had anything stolen this year at the marina. The man described his boat as a 23-foot ProLine 230 walk-around center console-style boat, with R.I. registration. It is docked at Slip #10 at C Dock. Waldman said there was no damage observed to the boat. Waldman said at the time of his investigation, there were no other boat owners in the area to be questioned, nor were there any cameras immediately located in the area. Waldman said he notified the marina manager of the larceny, who was going to look into the two cameras that are situated on the other side of the marina, for any possible evidence. He told the man if he becomes aware of any new information, to contact the Warwick Police Department so it can be added to the report. The case was forwarded to Detectives for consideration. No suspects or evidence.

SUSPENDED LICENSE

Officer Adam Arico was on routine patrol in his cruiser at 5:21 p.m. on Aug. 26, traveling on Inskip Way by the Herb Chambers Cadillac dealership at 1511 Bald Hill Road, when he observed a vehicle traveling directly in front of him, and after conducting a routine computer registration check, it was revealed the vehicle currently had a suspended registration, so he initiated a motor vehicle stop in the Herb Chambers Cadillac dealership parking lot.

Arico said he approached the vehicle and made contact with the two occupants of the vehicle; the male driver and female passenger. Arico said the driver presented his R.I. driver’s license and was positively identified as Kyle M. Peiczarek, 24, of 519 Washington Street, Apt. 5, Coventry, but when asked for his insurance and registration, he told Arico he lost his registration and was unable to produce it. After conducting a computer check on the license, Arico said Peiczarek’s license was currently suspended, but the female passenger’s license was active.

Peiczarek was issued a summons for Operating a Motor Vehicle with a Suspended Registration, with a mandatory R.I. Traffic Tribunal court date. He was also issued a citation for Driving with a Suspended License, with a mandatory Third Division District Court date. He was also issued a Third Division District Court Summons for Driving with a Suspended License, with the same Third Division District Court date. Arico said a family member of the female passenger responded and picked up both she and Peiczarek, while Peiczarek’s vehicle was towed from the scene. Arico said he seized both registration plates, which were transported to Warwick Police Headquarters, where they were entered into the Traffic Division mailbox.

    The boat owner may as well have left $765 in cash sitting on the seat of his boat. Most petty thieves are opportunistic, looking for the easy "score" with no confrontation and he gave them a perfect opportunity. Lock up your property if you plan on keeping it.
