HEAD-ON COLLISION

On Oct. 2 at 4:28 p.m., the Warwick Police Department responded to a serious head-on traffic collision in the area of 291 West Shore Road. The Traffic Division’s Accident Reconstruction Team is investigating the accident. The accident involved a 2006 Toyota Camry operated by a 29-year-old female from Warwick. Also in this Camry was a 3-year-old female juvenile rear seat passenger. This Camry struck a 2013 Chevrolet Silverado pickup, operated by a 40-year-old male from Warwick. A third vehicle, 2002 Volkswagen, operated by a 19-year-old female from Warwick, swerved to avoid the collision and subsequently went off the roadway into the woods against a tree.

The operator of the Camry was transported to Rhode Island Hospital by Warwick Fire Rescue with serious injuries. The juvenile female in the Camry was transported to Hasbro Hospital by Warwick Fire Rescue with serious injuries. The male operator of Chevrolet pickup truck was transported to Rhode Island Hospital by Warwick Fire Rescue with minor injuries. The female operator of the Volkswagen was not injured. As of 11 a.m. on Oct. 3, the female operator of the Camry and her female juvenile passenger were still listed in serious condition. The vehicle operators as well as the juvenile passenger’s identities were being withheld pending family notifications.

The preliminary investigation disclosed that the Chevrolet pickup truck was traveling eastbound on West Shore Road when the Camry traveling westbound on West Shore Road went left of center crossing into the pickup truck’s lane striking the truck in a head-on collision. The Volkswagen, which was traveling directly behind the Camry, swerved in an attempt to avoid the collision and went off the roadway and drove into a wooded area to the north side of West Shore Road and came to rest against a tree. Preliminary investigation shows that speed and alcohol do not appear to be a factor at this time.

The investigation is ongoing and any person with information related to the accident is requested to contact the Warwick Police Department Traffic Division. Contact either Sgt. Earl Read (468-4293) or Officer Chianese (468-4345), who is assigned as the lead investigator.

DUI OR REFUSAL

Officer John Zaborski and Officer Bogusz were dispatched to a multi-car accident in the area of Main Avenue and Buttonwoods Avenue at 8:12 p.m. on Sept. 28. Upon arrival, Zaborski said he observed a female sitting on the ground and a shorter stocky dark-skinned male walking in circles around a tree in the front yard of a residence on Main Avenue. When the female was asked if she needed a rescue, she said she would like one to respond for a medical checkup on her.

Zaborski said he then spoke with the male, who admitted he was involved in the accident. When asked if he needed a rescue, the man said he did not. As he spoke with the man, Zaborski said he detected a strong odor of alcohol emitting from his breath and the man’s speech was so slurred and mumbled, he had trouble understanding him. When asked what happened, the man said he believed is front passenger tire had fallen off causing his vehicle to strike one of the other vehicles involved in the accident. The man said he was driving westbound in the left hand lane when his vehicle struck the other vehicle. Zaborski said the man’s vehicle sustained crippling damage to the front passenger side tire. The man said he was the only person in his vehicle and he was driving. Zaborski said he observed the keys to still be in the ignition of the man’s Ford F-150.

As Zaborski continued to speak with the man, he said he was unsteady on his feet and kept swaying back and forth. When asked for his license, Zaborski said the man attempted to give him a Home Depot gift card before eventually finding his license and presenting it. When asked if he had consumed any alcoholic beverages, the man said he had four or five beers while eating at Sam’s Restaurant in Warwick within the past hour. Zaborski then asked the man if he would consent to a standardized field sobriety test, to which he agreed but told the officer beforehand he believed he could operate a vehicle safely. Zaborski then asked the man if he felt he would be under a 0.08, to which he smiled and said “probably not.”

Zaborski said he had to stop the test for the man’s safety, as he was observed to sway back and forth and use his arms for balance. Zaborski also said throughout the test, the man claimed he wasn’t drunk and he didn’t do anything wrong. When the man was advised the tests were finished, he told Zaborski he would blow into a “breath test” if he had one. Once an officer arrived on scene with a preliminary breath test, it was administered and Zaborski observed the reading to be 0.221. The man, identified as John Davis, 39, of 2199 Garden Way, Freeport, Penn., was then handcuffed and placed in a cruiser. While this was going on, Zaborski said officers were conducting an inventory of the man’s vehicle, in which they located a loaded Smith & Wesson 357 magnum under some articles on the floor.

Zaborski then asked Davis why he had the loaded hand gun, to which he replied he kept it incase he ever saw a police officer on the side of the road needing help he could use force if necessary. When asked why he did not tell officers the gun was in his vehicle, Davis said it had slipped his mind. He then advised Zaborski he had a license to carry out of Pennsylvania, to which Zaborski said it was not valid in Rhode Island.

Davis was then transported to Warwick Police Department headquarters, where he was afforded a confidential phone call but refused to submit to a Breathalyzer test. Davis told Zaborski he was in Rhode Island on business and had been here for about two weeks. He was issued a summons for Refusal to Submit to a Chemical Test and given a mandatory court date at the Rhode Island Traffic Tribunal. He was also issued a summons for DUI/B.A.C. unknown with a mandatory court date in Third District Court. Davis was also charged with one count of Carrying a Weapon While Intoxicated and one count of Carrying a Pistol Without a Permit. Due to the fact both are felonies, Zaborski said Davis would be held until court in the morning. Davis refused to sign his summonses, which were placed with his personal belongings.
