WILFULL TRESPASS

On Jan. 20 at 5:14 p.m., Officer Kevin McGuire was dispatched to Warwick Mall, 400 Bald Hill Road, for report of a suspicious male.

Upon arrival, McGuire met with a security officer, who said he approached the male subject, identified as Alexander Joel Cruz, 20, of 126 Putnam, Providence, in Lens Crafters after being called by the manager there about him acting suspiciously. Cruz was stumbling around and would not answer questions from the security officers.

Cruz was asked to step outside the store with security officials and once he did, he became very fidgety and kept reaching into his pocket. He was told to stop reaching into his pockets, but he did not comply so officer grabbed his arms, at which point Cruz became resistant and was handcuffed. McGuire said it should be noted a pair of $300 glasses from Lens Crafters were found hidden in Cruz’s pocket. The glasses were returned to the store, which did not wish to press charges for shoplifting.

McGuire said security advised him there was a no trespass order on file for Cruz that was entered on Dec. 20, 2015. McGuire then removed Cruz from the security officer’s handcuffs and placed him into his own handcuffs and escorted him to his cruiser. After consulting a sergeant that arrived on scene, McGuire said it was determined Cruz would be charged with one count of willful trespass.

Cruz was transported to Warwick Police headquarters, where he was printed, processed, and released with a District Court summons. Due to the fact Cruz was incoherent and apparently under the influence of some type of drugs, McGuire said he was transported to Kent Hospital and released into the care and custody of hospital staff.

FRAUDULENT USE OF CREDIT CARDS

On Jan. 18 at 9:22 a.m., Officer Rose Michel was dispatched to the lobby of the Warwick Police Department for a report of a larceny.

Upon arrival, Michel spoke with a woman, who said on Jan. 17 at approximately 5 p.m. she visited the TJ Maxx/Home Goods store located at 1245 Bald Hill Road. At approximately 6:05 she said she went to the register to attempt to pay for the merchandise, but when she reached in her purse, she noticed her wallet was missing. She said she was positive the wallet was in her purse prior to entering the store.

She told Michel she had her purse in sight at all times, except when she visited the Clearance aisle, where a male subject she described as being approximately 5’10” with a tan complexion and an islander’s accent requested her assistance. She assisted the male and approximately 30 seconds later, another male subject matching the same description also requested help with another item. The woman said her purse was zipped closed in the shopping cart and her coat was draped over it. She described the wallet as a Michael Kors red patent leather wallet with the symbol MK, valued at $50. It contained the following: Medicare health and dental insurance card, with her Social Security number printed on them; driver’s license; flexible spending Blue Shield debit card; miscellaneous reward discount cards; JC Penney store credit card; Home Depot store credit card; People’s United Bank Debit MasterCard; Capital One MasterCard; and $50 in U.S. currency.

After leaving the store, she said she contacted People’s United Bank, who informed her the debit card was used and charged $1,015.43 at 5:45 p.m. at a Target store in Warwick. She said she also contacted Capital One and cancelled that card, which had two unsuccessful attempts for a total of $2,000 made at a Target in Warwick, both of which were declined. She said there were no activities made on the JC Penny or Home Depot cards. She said she did not authorize anyone to use her credit cards and would like to press charges.

DUI & REFUSAL

On Jan. 12 at 3:48 p.m., Officer Gregory Accinno and Officer DiNardo responded to the intersection of Main Avenue and Bailey Street for the report of a motor vehicle accident. Upon arrival, Officers Chianese and Jason Cooke were already on scene and directed Accinno to one of the operators, identified as Robin Spellman, 53, of 161 Bradford Avenue, East Providence. Upon engaging Spellman in conversation, she said she had a couple alcoholic beverages.

Prior to speaking with Accinno, Officer Cooke said he spoke with Spellman, who said she had no idea where she was coming from or where she was, but that she was trying to get to Bald Hill Road. She admitted to driving the vehicle at the time of the crash and said there were no other passengers or occupants.

While speaking with Spellman, Accinno said she almost lost her balance and used her vehicle to hold herself up. Talking with her further, he said her speech was slurred, he could detect the odor of an alcoholic beverage on her breath, and her eyes were bloodshot, watery and glossy.

Spellman consented to a series of standardized field sobriety tests, the last of which was terminated for her safety because she said her hip was in too much pain and she could not lift either of her legs. Prior to the tests, Spellman told Accinno she was blind in her right eye and had a rod in her hip. Spellman said she would give a breath sample, however Accinno said she provided several insufficient samples and claimed she was unable to provide a breath. Based on his observations and investigation, Accinno concluded Spellman was unable to safely operate a motor vehicle at this time and was placed under arrest for suspicion of driving while under the influence of intoxicating liquor and/or drugs.

Spellman was then transported to Kent Hospital, where she refused to submit to a blood sample. Spellman was making complaints of severe hip pain and was admitted by hospital staff. Spellman was issued a violation for DUI/Drugs/Alcohol/1st Offense-BAC Unknown with a Third District Court date. She was also issued a violation for Refusal to Submit to Chemical Test 1st Offense with a Rhode Island Traffic Tribunal court date. She was later discharged from the hospital and released into the custody of a sober adult.
