GRAFFITI

On Jan. 19 at 11:52 a.m., Officer Gregory Accinno was dispatched to Hoxsie Elementary School, located at 55 Glenwood Drive, for the report of vandalism.

Upon arrival, Accinno met with Hoxsie principal Gary McCoombs, who said when he arrived to work at 7 a.m., it was brought to his attention that a wall on the rear of the school had been spray-painted with graffiti. He said the graffiti was not there before he left for the weekend on Jan. 15.

Accinno said an additional exterior check of the school was performed and checked clear. Photos of the graffiti were taken.

AUTO THEFT

On Jan. 20 at 1 a.m., Officer Charles Austin and Officer Andrews were dispatched to the Grid Iron Ale House at 1599 Post Road for the report of a stolen motor vehicle.

Upon arrival, Austin spoke with a man, who said he was working at the bar and went out at approximately 12:45 a.m. to warm up his car. He went back inside the bar to finish some things up and when he came back outside to smoke a cigarette he noticed that his vehicle was no longer there and called the police.

Andrews made a check of the area, the neighborhood behind the bar, and also on the other side of Post Road, all with negative findings. The vehicle was described as a black 2010 Ford Mustang with a red racing stripe down the center, bearing R.I. registration 448-070.

When asked if it were possible someone was playing a prank on him because he frequents the bar and knows a lot of people there, the man said he called all of his friends and his wife, but no one had brought the car to his house and he had not received any phone calls from any friends saying they were playing a prank on him.

Austin entered the vehicle as stolen. He said there was no evidence to process and the bar does not have any surveillance facing the outside of the bar. The only surveillance is on the inside of the bar.

SHOPLIFTING

On Jan. 21 at 8:55 p.m., Officer Brian Fontaine, along with Officer Lo and Officer Chea were dispatched to Wal-Mart at 840 Post Road for a report of shoplifting in progress. Prior to my arrival, dispatch advised that Loss Prevention had one male in custody, but he was being a problem.

Upon arrival, Fontaine met with an asset protection associate, who said he observed a male, later identified as Jairo Mezquita Martinez, 23, of 112 Sasafrass, Providence, behaving suspiciously in the electronics department of the store. He said Martinez picked up an automotive FM radio transmitter and moved to the domestics area in the store, where he removed the transmitter from its packaging and conceal it inside his jacket pocket. He then went to the front of the store, paid for other items, then passed all points of purchase and made no attempt to pay for the transmitter and exited the building. Martinez was approached by asset protection and escorted him back inside. He was cooperative at first, but once he was inside the security office Martinez became aggressive and produced a closed pocket knife, saying, “I’m going to **** you up.”

The merchandise was recovered and the total value of the item was $48.88. Asset protection said they wish to pursue a criminal complaint and requested a No Trespass Order be issued against Martinez.

DUI

On Jan. 18 at 2:31 a.m., Officer Melissa Schlitzer was on routine patrol in the area of the Shaw’s Market on Warwick Avenue when she saw a vehicle turning around in the parking lot. She said the driver’s side rear bumper was dragging on the ground and it appeared the vehicle had recently been in an accident.

Schlitzer said she began following the vehicle, as it traveled southbound on Warwick Avenue, where she clocked it going 60 miles per hour in a 35 mile per hour zone. She said the vehicle crossed the double yellow line twice and almost struck the curb twice, before swerving into the northbound lane heading southbound and missed a telephone pole by a few feet.

Schlitzer immediately initiated a motor vehicle stop and made contact with the operator, identified as Adam F. Baker, 36, of 49 Irving Road, Warwick. Baker said he was driving from his house on Irving Road en route to the store to purchase cigarettes. Schlitzer said it should be noted that Baker had three packs of cigarettes on the front seat and he seemed confused by the questions she was asking him. He was asked several times for his driver’s license, which he could not produce and fumbled with his wallet repeatedly. When asked about the damage to his rear panel and bumper, Baker said his wife was in a car accident at some point that evening, but he could not recall any details of what happened. When Schlitzer informed him that his rear bumper was dragging on the ground, Baker said he was unaware of it.

While speaking with Baker, Schlitzer said she could detect an odor of an alcoholic beverage on his breath, his eyes were glossy and his speech was slurred. When asked if he had consumed any alcohol that day, Baker said “yesterday, what day is it?” He said he had a couple of drinks with his wife at some point the day before but could not recall the time of day. Schlitzer said when Baker exited the vehicle to undergo standardized field sobriety tests, he was unsteady on his feet and had to use the door jam to stabilize himself.

Based on Baker’s performance on the sobriety tests, the motor vehicle observations, and his condition, it was determined Baker was unfit to safely operate a motor vehicle and he was placed under arrest for suspicion of driving under the influence of intoxicating liquor and/or drugs and transported to the Warwick Police Department headquarters, during which he said he had taken Ambien that day but could not recall what time or the dosage.

Once at headquarters, Baker agreed to take the breathalyzer test and registered a 0.323 B.A.C. and 0.306 B.A.C. Baker was then fingerprinted, processed and given summons for DUI of Liquor and/or Drugs 2nd Offense .15/greater, as he had a previous conviction of DUI on Oct. 28, 2015. He was also summonsed for Driving After Suspension of License/Revoke License for Certain Violation, which was also due to his prior DUI conviction. Both summons were for a Third District Court date. He was also issued a violation for Speeding; Conditions Requiring Reduced Speed; and No Insurance on Person 1st Offense, with a Rhode Island Traffic Tribunal court date. Due to his breath results exceeding 0.300, Baker was then transported to Kent Hospital for detox.

    Mr. Martinez was fortunate that the loss prevention officer displayed such a calm demeanor; producing a closed knife and threatening someone verbally should have earned Martinez a short nap on the floor, followed by numbness and swelling of the face (from laying on the floor, of course).
