WHY THEY CAUGHT

On April 24, at about 2:30 p.m., Officer James Vible responded to the food court at Warwick Mall, 400 Bald Hill Road, for the report of a male displaying a knife.

Mall Security Officer James Crosby was speaking with the man, later identified as Jospcar Gomez-Cueto, 18, of 59 Health Avenue, Providence, near the carousel on Vible’s arrival. Cueto, who was cooperative and polite with security and police, said he was only using the folding knife to clean his shoes and not displaying it to intimidate or threaten anyone. Security advised that Cueto had been cooperative and voluntarily handed over the folding knife without hesitation. Vible secured the knife and asked Cueto if he had any other weapons, to which he said no.

Dispatch advised Cueto had a warrant for his arrest out of Sixth District Court for failure to appear on Feb. 24, 2016. Cueto was placed under arrest, searched, and secured in a patrol car without incident.

Cueto was transported to Warwick Police headquarters, where he was processed and held pending the next session. The warrant was removed from the system.

SHOPLIFTING

On April 17 at 6:18 p.m., Officer Eric Lima was dispatched to the loss prevention office at the Stop & Shop grocery store, 575 Greenwich Avenue, for the report of one adult female in custody for shoplifting.

Upon arrival, Lima met with a loss prevention associate, who said at approximately 5:30 p.m., she observed a female customer, later identified as Kristin E. Phelps, 30, of 101 Wine Street, Cranston, select Stop & Shop bags from a rack and placed the empty bags in a carriage and traveled amongst numerous departments, selecting several items and placing them inside. She then continued with those items, passing all points of sale without making payment, and exited the store. Phelps was approached outside the store by loss prevention and escorted back inside, where 39 items worth a total value of $232.18 were recovered. The loss prevention agent said on behalf of Stop & Shop she would like to file a complaint.

Phelps was taken into custody and transported to Warwick Police headquarters for processing. Upon completion of processing, Phelps was issued a Third District Court summons for shoplifting and was then released.

DUI

On April 24 at 12:50 a.m., Officer Matthew Smith assisted Sergeant Jedidiah Pineau on a motor vehicle stop in the parking lot of Seasons Corner Market, 2128 Elmwood Avenue. Pineau advised that he observed a blue 2010 Toyota Scion traveling 65 miles per hour in a 35 mph posted zone on Post Road prior to Elmwood Avenue, heading in a southbound direction. Pineau said he also saw the vehicle swerve back and forth between the two lanes of travel.

Smith made contact with the operator, who was identified as Marcus Fontes, 20, of 48 Parkway Avenue, Cranston. Smith said Fontes’ eyes were severely bloodshot and he was chewing gum, which is commonly used to mask the odor of an alcoholic beverage. Upon speaking with Fontes, his speech was slurred. When asked if he knew how fast he was going, Fontes said “65” and that he was in a rush to get cigarettes from the Seasons Corner Market. When asked if he had consumed any alcoholic beverages prior to operating his vehicle, he said he had approximately two Samuel Adams bottled beers.

Based on Sergeant Pineau’s observations and Smith’s interaction with Fontes, he was requested to submit to a series of standardized field sobriety tests, to which he agreed. While speaking to Fontes outside the vehicle, prior to administering the tests, Smith said he could detect a moderate odor of an alcoholic beverage emanating from his breath.

Smith said the test had to be stopped for Fontes’ safety. Based on observations, interaction, and his performance on the tests, Smith determined Fontes was unfit to safely operate a motor vehicle and placed him under arrest for suspicion of driving while under the influence of intoxicating liquor and/or drugs.

Fontes was transported to Warwick Police headquarters without incident. Upon arrival, Fontes agreed to submit to a chemical test and registered readings of 0.148 B.A.C. both times.

Fontes was fingerprinted, photographed, and secured in a cell. He was issued a citation for DUI of liquor or drugs – 1st offense .10-.15 and assigned a Third District Court date. He was also issued a citation for speeding and laned roadway violations and assigned a Rhode Island Traffic Tribunal court date. Fontes was then released to a sober adult and mailed a copy of his breath test results. His vehicle was towed from the scene.
