DUI AND REFUSAL

Officer John Zaborski reported he was dispatched to Buttonwoods and Main Avenues around 5 p.m. on March 3 for an erratic driver. He said he found the car heading north on Buttonwoods and followed as it crossed the double yellow lines several times before he stopped it. He said the driver smelled of alcohol and appeared to be intoxicated. He said the driver admitted he had “two shots of booze” earlier and had taken an Adderall for his ADD and that he had smoked some marijuana. Zaborski asked him if he thought he should be driving and he replied, “probably not.” Zaborski learned there was a warrant out for the driver’s arrest for failure to appear on a charge out of Providence. He said that the driver could not finish a field sobriety test and was taken to headquarters. An inventory of his car produced a baseball bat wedged between the driver’s seat and the door and a set of brass knuckles were found wedged between the seat and the console. He said they showed him the brass knuckles and he claimed they were not real, that they were part of a belt buckle but Zaborski noted that they were solid metal “and could definitely inflict pain on a person.”

He said the driver refused to take a breath test at headquarters. Reynaldo D. Montanez, 34, of 23 Ida St., Providence, was charged with DUI, refusal, laned roadway violations, and with carrying illegal weapons other than firearms. He was later transported to the ACI to be held as a probation violator for the weapons charges.

Officer Gauvin reported he was on patrol around 1:20 a.m. on Feb. 28 when he saw a car leave Picasso’s Pizza by driving over the curb without stopping and then stopping at a green light at Sandy Lane, stop for a few seconds before turning onto Sandy Lane and then swerve out of and back into its lane and then out again. He said he pulled the car over at Trent Avenue and approached the driver. He said the driver appeared to be under the influence and smelled of alcohol. He said she had two IDs in her purse, one of which was hers and another belonging to an older sister, but the one she presented to Gauvin was her own. He said he asked her how many drinks she had and she said one; then he asked her again and she said two; and asked again and she said “three Captain and cokes” at Picasso’s. He said he administered a field sobriety test to the driver and she failed it. Jessica L. Mullowney, 20, of 75 Birchwood Ave., North Kingstown, was taken to headquarters, where she blew a .202 and a .190 blood alcohol content on the breath test. She was charged with laned roadway violations, improperly entering the roadway and disobedience of traffic devices. She was later released to a sober adult.

Officer Matthew Moretti reported stopping a car he saw hit the curb on Post Road around 11:45 p.m. on March 14. He said the driver slurred his words, smelled of alcohol and appeared to be drunk. He said he gave the man a field sobriety test that he failed and got a .162 blood alcohol content on the portable breath tester. Jason Rose, 34, of 8 Hillcrest Ave., Greenville, was charged with DUI, refusing a breath test at headquarters and laned roadway violations.

Officer Javier Cabreja reported seeing a car crossing the double yellow lines on Warwick Avenue at a high rate of speed around 1:25 a.m. on March 9. He said he pulled the car over at Glendale Avenue and noticed the driver appeared drunk and smelled of alcohol. He said he administered a field sobriety test on the driver and he failed it. Francis J. Collins, 49, of 60 Lyman Ave., Warwick, was taken to headquarters, where he refused to take a breath test. He was charged with DUI, refusal, second offense, speeding and laned roadway violations. He was held without bail and remanded to the ACI.

Officer Matthew Moretti reported stopping a car on Jefferson Boulevard he clocked at 50 miles per hour around 9 p.m. on March 9. He said the driver smelled of alcohol and appeared intoxicated. He said the driver failed a field sobriety test and refused a preliminary breath test. Joshua J. Fusco, 37, of 34 Forest Park Dr., North Kingstown, was charged with DUI, refusal, speeding, running a red light and leaving the lane of travel. He was later released to a sober adult.
