A Public Hearing on the following proposed Ordinances will be held before the Ordinance Committee on Thursday, July 12, 2018 at 7:00 p.m., City Council Chambers, 869 Park Avenue, Cranston, R.I. pursuant to Section 3.12 of the Charter.

PROPOSED ORDINANCE NO. 06-18-01 UTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE A GRANT OF EASEMENT FOR THE NARRAGANSETT ELECTRIC COMPANY

It is ordained by the City Council of the City of Cranston as follows:

Section 1: That the Public Works Director of the City of Cranston be and is hereby authorized to execute a required Grant of Easement to the Narragansett Electric Company, in connection with the perpetual right and easement to construct, reconstruct, repair, maintain, operate and patrol, for the transmission of high and low voltage electric current and for the transmission of intelligence and telephone use, TWO (2) anchors,(which may be erected at different times) and all necessary equipment and appurtenances (hereinafter referred to as the “ANCHORS”) over, across, under and upon the Grantor’s land on Laten Knight Road in Cranston, Rhode Island and for other purposes , which are set forth in the Grant of Easement which is hereby attached and labeled Exhibit “1”, and map labeled Exhibit “A”.

Section 2. That the Public Works Director of the City of Cranston be, and is hereby authorized to do and cause to be done any and all acts necessary or proper in connection with or for carrying out this Ordinance and the execution and delivery of the Grant of Easement.

Section 3. This Ordinance shall take effect upon its final adoption.

PROPOSED ORDINANCE NO. 6-18-03 IN AMENDMENT OF TITLE 15.12 , OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “BUILDING CODE” (Housing Standards On Line Monitoring of Complaints)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1: Title 15.04 entitled “Building Code” is hereby amended by adding thereto the following new section:

15.04.121. Complaint Electronic Monitoring

Department of Inspections shall maintain an on line record of the status of all complaints of building code violations. The on line record shall be accessible to the public on the city’s website. Organized by the address of the subject of the complaint, the record shall include the date and specifics of the complaint. It shall not include the identity of the complainant. It shall also include the date and results of the Department of Inspections investigation, the dates and responses to notices of violation and the dates and results of municipal court proceedings.

SECTION 2. This Ordinance shall take effect upon its final adoption.

PROPOSED ORDINANCE NO. 6-18-08 IN AMENDMENT OF TITLE 15.12 OF THE CODE OF THE CITY OF CRANSTON, 2005, ENTITLED “BUILDING CODE” “HOUSING STANDARDS” (Short Term Rentals)

It is ordained by the City Council of the City of Cranston as follows:

SECTION 1: Title 15.12 entitled “Housing Standards” is hereby amended by adding thereto the following new Chapter:

15.12.780 Short Term Rentals

The provisions of this Chapter shall apply to all rental dwelling units within the city except those defined as hotels, motels, bed and breakfasts and rooming houses.

For the purposes of this chapter, the following definitions shall apply:

A. “Dwelling unit” means a room or rooms connected together, constituting an independent housekeeping unit and containing a single kitchen.

B. “Registrar” means the Building Inspector of the City of Cranston.

Registration required.

All rental dwellings which are let, leased, or otherwise occupied, in whole or in part, by a tenant for residential and/or dwelling purposes for a period of nine months or less, shall be registered by the record property owner thereof with the Building Inspector .

C. Exception.

This chapter shall not apply to any premises on which the owner thereof maintains his or her principal residence.

D. Rental registration form.

The rental registration form shall indicate the tax assessor’s plat and lot number, address of the rental dwelling unit, the number of rental dwelling units therein, the name and permanent mailing address of the record owner and the rental agent, and the usual period of occupancy by tenants (summer, monthly, weekly or other).

E. Filing date—Term.

On or before January 1st of each year, the record owner of the rental dwelling unit shall file the completed rental registration form with the registrar, which registration shall be valid for a one year period from January 1st to December 31st of the same year. If the property is registered during the calendar year, the registration shall be valid until December 31st of that same year.

F. Fee.

There shall be an annual registration fee of twenty dollars ($20.00) for each dwelling unit covered under the provisions of this chapter plus a twenty-five dollar ($25.00) minimum housing inspection fee for each short-term rental dwelling unit on the property, payable at the time of registration.

G. Posting of notice by owner.

The record owner shall post, in plain view and in a conspicuous place within the rental dwelling unit, a notice containing the ordinances of the city with regard to the noise ordinance, the dog leash law, trash disposal, parking, dwelling occupancy limits and snow removal and disposal. The record owner of a dwelling unit or any person in control or possession of said dwelling unit subject to the provisions of this chapter, shall cause a copy of the active lease, with the printed names of all tenants and the registration form required by this chapter to be posted or fixed to the inside of the primary access door to said dwelling unit, so as to allow the lease and registration form to be readily available for inspection by police, zoning, building or minimum housing officials of the City of Cranston. Such notices shall be available at the office of the Building Inspector.

SECTION 2. This Ordinance shall take effect upon its final adoption.
