AN ORDINANCE AMENDING THE CITY OF WARWICK ZONING ORDINANCES
TOWERCO 2013, LLC AND CELLCO PARTNERSHIP,
D/B/A VERIZON WIRELESS, APPLICANT
150 DRAPER AVE
ASSESSORS PLAT 354, LOT 49

Be it ordained by the City of Warwick:

Section I: The Zoning Map and the Record Book of Lot Classifications which are a part of the Zoning Ordinances of the City of Warwick are hereby amended by changing the classification of the following described premises from Residence A-10 (A-10) to Residence A-10 (A-10) with variances and authorization for Use Code 611 to locate a telecommunications tower and facilities on the property in connection with a lease between the City of Warwick as landlord and TowerCo 2013, LLC as tenant, with Verizon Wireless as a subtenant use:

Assessor’s Plat 354, Assessor’s Lot 49, as said plat appeared in the Tax Assessor’s office on December 31, 2024 is hereby changed from Residence A-10 (A-10) to Residence A-10 (A-10) with variances and authorization for Use Code 611. The lot is set forth in the legal description and on the map attached hereto as Exhibit A.

Subject to the following conditions, waivers and stipulations:

  1. Relief from Section 506(C)1, location within two miles of another facility.
  2. Relief from Section 506(C)4.i, minimum setback from residential and open space zoning districts.
  3. Relief from Section 506(C)5, tower height limitation.
  4. Relief from Section 506(C)7, underground utilities.
  5. On the condition that any trees to be removed shall be marked prior to and discussed at a pre-construction meeting at which a land trust member shall be invited to attend and participate.

Section II:  The Clerk of the Zoning Board of Review is hereby authorized and directed to cause said changes to be made on the Zoning Map and the Record Book of Lot Classifications.

Section III:  This Ordinance shall take effect upon passage and publication as prescribed by law.
