At approximately 10:50 p.m. on Oct. 7, Officer David Boardman was conducting a routine patrol on Bald Hill Road when he observed a vehicle, described as a 2015 Subaru Forrester, exit the parking lot of the McDonald’s and enter the northbound lanes.

“The vehicle failed to yield while exiting the private parking lot … almost causing an accident with my police cruiser,” Boardman reports. “I had to slam on the brakes and swerve into the left lane of travel to avoid a collision with the vehicle.”

Boardman observed the vehicle “make several laned roadway violations as it quickly sped up” and continued north on Bald Hill Road, “weaving in both lanes of travel.” Its erratic operation continued as it turned on to East Avenue, where the officer was finally able to initiate a motor vehicle stop near the Interstate 95 overpass.

Boardman made contact with the vehicle’s male operator and reports immediately detecting the odor of alcohol on the man’s breath. The operator is said to have exhibited “mildly bloodshot and watery eyes” and acknowledged consuming alcohol that evening.

The operator is said to have agreed to undergo field sobriety testing, which he reportedly failed.

Schwarz was later released into the custody of a sober adult with a summons to appear in Third Division District Court on a charge of driving under the influence.
