II. PUBLIC HEARINGS AS ZONING BOARD OF REVIEW - Discussion and/or action and/or vote regarding the following petitions. The Zoning Board may approve, approve with conditions or deny the following petitions/applications, as may be modified by testimony and/or evidence presented throughout the public hearing; and/or possible vote to continue a petition’s public hearing to a date determined.

Petition #10825---Ward 6---104 Hemlock Ave.

The petition of Rosemary Shaw, 6087 Drake St., Jupiter, FL, requests a dimensional variance to construct a 22’ x 25’ one-story attached garage having a front yard setback   of 21.47’ along Hawthorn Ave. (30’ required); construct a 20’ x 4.67’ porch having a front yard setback of 21.41’ along Hawthorn Ave. (30’ required); and construct an         L-shaped porch having a front/corner yard setback of 18.89’ along Hemlock Ave.       (30’ required).  Assessor’s Plat 373, Lot 56, zoned Residential A-15. (Previously approved on 8/9/2022 – Requesting a one year extension).

Petition #10918---Ward 5---Chapin Ave.

The petition of Peter & Robin Stevens, 91 Priscilla Ave., Warwick, RI, and Bernard & Bernice Johnston, 42 Priscilla Ave., Warwick, RI, requests a dimensional variance to construct a new single family dwelling on a 4, 196 sq. ft. lot (7,000 sq. ft. required), with a front yard setback of 11.1’ (25’ required), a front deck with a 3.1’ front yard setback (17’ required).  Assessor’s Plat 380, Lot 262, zoned Residential A-7.

Petition #10919---Ward 5---135 Palmer Ave.

The petition of Christina Befumo, 135 Palmer Ave., Warwick, RI, requests a dimensional variance to construct a full second story addition to the existing non-conforming single family dwelling.  Proposed addition having a setback of 14.3’ to the front property line along Palmer Avenue (25’ required), and a setback of 14.5’ from the side property line (15’ required).  Subject property being a pre-existing non-conforming undersized lot having 8,368 sq. ft. (10,000 sq. ft. required).  Assessor’s Plat 357, Lot 415, zoned Residential A-10.

Petition #10920---Ward 4---600 Cole Farm Rd. C-12

The petition of Joseph Abatiello, 600 Cole Farm Rd., Warwick, RI, and Gregory & Joy Dicomitis, 44 Desoto St., Cumberland, RI, requests a dimensional variance from Section 304.4 to have more than one single family dwelling on a lot.  The petitioner is proposing to demolish the existing single family dwelling to construct a new 24’ x 40’ single family dwelling with a 19’ x 10’ rear deck.  Assessor’s Plat 315, Lot 136, zoned Residential      A-10/A-15.

Petition #10921---Ward 6--- 139 Gordon Ave.

The petition of Shoreline Properties, 400 South County Trail, Exeter, RI, and Montauk Shores Realty, LLC, 200 Metro Center Blvd., Warwick, RI, requests a dimensional variance to construct a new single family dwelling.  Proposed dwelling having a  front/corner yard setback of 20’ from Pearl Ave. (25’ required).  Assessor’s Plat 361, Lot 746, zoned Residential A-7.

Petition #10915---Ward 4---Old Mill Blvd./Higney Ave.

The petition of Harrington Realty, LLC, 39 Dees Circle, Warwick, RI, and Jewel Associates, LP, 51 Woodbury St., Providence, RI, requests a dimensional variance to construct a new 20’ x 30’ single family dwelling with a built-in garage on the first floor and living space on the second and third floor.  Subject property having a lot area of 6,630 sq. ft. (40,000 sq. ft. required), less than required frontage along both street fronts, and less than required lot width.  Proposed dwelling having a setback of 6’ (40’ required) from the front property line along Old Mill Blvd., a side yard setback of 6.3’ to the deck, and a side yard setback of 8’ (30’ required) to the dwelling.  Assessor’s Plat 334, Lot 112, zoned Residential A-40.  (Continued from July 11, 2023)
