On or about September 4, 2023 the Warwick Housing Authority will submit a request to the U.S. Department of Housing and Urban Development for the release of Capital Improvement Funds under Section 9 of the United States Housing Act of 1937, as amended (42 U.S.C. 1437), to undertake the following: Scattered Site Asphalt Shingled Roof Replacement, located at 50 Lawn Avenue, Warwick, Rhode Island. The purpose of the project is to replace the existing asphalt shingles with new architectural style asphalt shingles and related sheathing replacement/repair at this three (3) unit property, which is owned and operated by the Warwick Housing Authority). The estimated cost of the project is $10,000.00 (HUD Capital Improvement funds).
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) on file at the City of Warwick’s Office of Housing & Community Development, 65 Centerville Road, Suite I (2nd Floor), Warwick, RI 02886 where the record is available for review and may be examined or copied weekdays 8:30 A.M to 4:30 P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Warwick Office of Housing Community Development, 3275 Post Road, Warwick, RI 02886. Comments can also be emailed to melissa.j.foley@warwickri.gov. All comments received by September 1, 2023 will be considered by the City of Warwick & Warwick Housing Authority prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Warwick certifies to HUD that the Mayor, Frank J. Picozzi, in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Warwick Housing Authority to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of fund and the City of Warwick certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following basis: (a) the certification was not executed by the Certifying Officer of the City of Warwick; (b) the City of Warwick has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and can be either emailed to HUD Region 1 at CPDRROFBOS@hud.gov or mailed to the following address:
